Jerry successfully completed The Breath Alcohol Technician Course in accordance with the Code of Federal Regulations as implemented by the United States Department of Transportation and holds a Certificate of Completion as a Practitioner in Standardized Field Sobriety Testing pursuant to the National Highway Traffic Administration (NTSHA) and the International Association of Chiefs of Police (IACP). This SFST course covers the same course material that the Austin DWI police receive in their training.
Jerry also completed Advanced Training in the Standardized Field Sobriety Tests, Horizontal Gaze Nystagmus: Vision Science Perspectives Course. He is a member of the National College of DUI Defense Attorneys (NCDD) and the National Association of Criminal Defense Lawyers (NACDL). Mr. Smith has attended numerous seminars devoted to DWI defense over the past 15 years, including the 2008 Annual NACDL and NCDD Winning the DUI: Offense, Defense & Special Teams event in Las Vegas, Nevada and the 2009 NCDD Mastering Scientific Evidence Event in New Orleans, Louisiana. In December, 2012, he received a Certificate of Completion of the NHTSA/International Association of Chief’s of Police Standardized Field Sobriety Testing (SFST) Practitioner Student Course. December 31, 2014, he was given a Certificate of Completion of the NHTSA/International Association of Chief’s of Police Drug Evaluation and Classification (DECP/DRE) Overview Class; National Highway Traffic Safety Administration (NHTSA/International Association of Chiefs of Police (IACP) Standardized Field Sobriety Testing Instructor Course (2015 curriculum) CO – Instructor – January 2017 . He stays current on developments in DWI law and devotes approximately 75% of his time to the defense of citizens charged with an Austin DWI.
Jerry has tried both civil and criminal jury trials in the United States District Courts in the Southern and Eastern Districts of Texas as well as numerous felony and misdemeanor jury trials in Travis, Williamson, Hays, Caldwell, Bastrop, Harris, Fort Bend, Dallas, McClennan, Smith, Harrison, Rusk, and Gregg Counties. The last 5 felony DWI trials have resulted in 1 hung jury (the State choosing to reduce to a misdemeanor rather than retry the matter to another jury), 3 jury verdicts of “Not Guilty” and 1 verdict of ‘Not Guilty” from a judge sitting without a jury. Jerry is proud of his standing and reputation among judges and prosecutors he regularly practices before and that reputation for competence and integrity inures to the benefit of a great many clients charged with a variety of serious criminal offenses. In 2013 and 2014 he a member of the faculty at the Evidence Boot Camp sponsored by the Center For American and International Law in Plano, Texas.
Jerry attended Sam Houston State University (B.S. Criminology 1973), and received his legal education from South Texas College of Law (Doctor of Jurisprudence, 1979). Jerry is a member of the State Bar of Texas, Texas Criminal Defense Lawyers Association, Austin Criminal Defense Lawyers Association, DUI Defense Lawyers Association and Williamson County Bar Association. In March, 2015, he was admitted into membership in The National Association of Distinguished Counsel as a Member of the Nation’s Top One Percent.
